1. Acceptance of Terms

By accessing or using Track Pulse ("the Service"), operated by OutSmart Labs LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Track Pulse is a social media monitoring platform that tracks Instagram and TikTok for posts, stories, mentions, hashtags, and location tags related to your business. We provide campaign reports, creator discovery, and analytics through our dashboard.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You must be at least 18 years old to use the Service

4. Subscription Plans

Track Pulse offers the following subscription tiers:

  • Starter ($499/mo) — Single platform monitoring with mentions tracking
  • Growth ($999/mo) — Hashtag and location tracking with expanded discovery
  • OutSmart ($4,999/mo) — Full Instagram + TikTok coverage with dedicated account manager

Pricing is subject to change with 30 days written notice. Coupon codes, when provided, apply to the terms specified at the time of redemption.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Use the data obtained through our Service to harass, stalk, or harm any individual
  • Resell, redistribute, or sublicense the Service without written consent
  • Reverse engineer or attempt to extract the source code of our software
  • Exceed the usage limits of your subscription plan

6. Data and Content

Track Pulse monitors publicly available social media content. We do not claim ownership of any third-party content discovered through our monitoring. You are responsible for how you use the data and insights provided by our Service, including compliance with applicable privacy and data protection laws.

7. Intellectual Property

The Service, including its design, features, and content (excluding third-party social media data), is owned by OutSmart Labs LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, OutSmart Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Social media platform changes, API limitations, or maintenance may temporarily affect monitoring capabilities. We will notify you of planned maintenance when possible.

10. Termination

Either party may terminate the subscription with 30 days written notice. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the dashboard and data will be revoked, and stored data will be deleted within 90 days unless otherwise required by law.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
